Supreme Court Justice Samuel Alito recently revealed that he had a phone conversation with President-elect Donald Trump regarding the qualifications of one of his former law clerks, William Levi, for a potential government position. In a statement issued on Wednesday, Alito confirmed that the discussion revolved solely around Levi’s qualifications and was initiated at Levi’s request. “William Levi asked me to take a call from President-elect Trump regarding his qualifications to serve in a government position,” Alito explained.
Alito emphasized that the discussion did not touch on any legal matters involving Trump, including his pending sentencing in a hush money case, which was the subject of a high-profile emergency appeal filed by Trump the following day. While it is common for justices to recommend former clerks for government roles, the timing and nature of the call have raised eyebrows, particularly given the context of Trump’s legal battles.
Critics Question the Timing of the Call
The timing of the call, which took place just one day before Trump filed a request with the Supreme Court to delay his sentencing, has drawn significant attention. Critics, particularly those from the left, have raised concerns about the potential implications for the independence of the judiciary. Samuel Alito, a conservative member of the Supreme Court, has faced scrutiny in the past, especially regarding his ties to Trump and controversies surrounding his properties in Virginia and New Jersey.
Although Alito firmly stated that no discussions regarding Trump’s legal case occurred, critics like Gabe Roth, executive director of the advocacy group Fix the Court, argue that the call could be seen as an opportunity for Trump to engage with a justice whose court will soon be handling critical cases involving him. Roth remarked that the call was “merely an excuse” for Trump to speak with a key figure in the Supreme Court, especially with his sentencing looming.
Levi’s Career and Trump’s Legal Challenges
William Levi, who clerked for Samuel Alito in 2011, has an extensive career in federal government, having held various prominent positions, including chief of staff to Attorney General William Barr and chief counsel to Senator Mike Lee. Despite the criticisms surrounding the call, Levi’s credentials are not in question.
Trump’s efforts to delay his sentencing are facing challenges. The Supreme Court typically refrains from intervening in such cases unless they are urgent, and given that Trump’s case is still ongoing in New York, the chances of the court granting his request remain slim.
On the other hand, some Republican figures, including Representative Tony Gonzales, have defended the call, dismissing concerns and highlighting the importance of open communication across all branches of government. Gonzales expressed his belief that such conversations should be viewed as a positive development.
